Waiver of Liability, Release, and Media Consent Agreement

InTouch Outreach (ITOR) is a nonprofit organization organized under the laws of the State of Indiana.

By participating in any programs, services, events, or activities (collectively, the “Activities”) offered by InTouch Outreach (ITOR), whether in person, off-site, or virtually, I acknowledge and agree to the following:

Assumption of Risk

I understand that participation in the Activities may involve inherent risks, including but not limited to physical injury, emotional distress, illness, property damage, or, in rare circumstances, death. I voluntarily and knowingly assume all risks associated with my participation, whether known or unknown.

Waiver and Release of Liability

To the fullest extent permitted by the laws of the State of Indiana, I hereby release, waive, discharge, and hold harmless InTouch Outreach (ITOR), including its directors, officers, employees, volunteers, contractors, partners, and affiliates, from any and all claims, demands, damages, rights of action, or causes of action of any kind, whether known or unknown, arising out of or related to my participation in the Activities, including any claims arising from the negligence of InTouch Outreach (ITOR).

I understand that this release does not apply to claims resulting from gross negligence, willful misconduct, or any other liabilities that cannot be waived under applicable law.

Medical Acknowledgment and Consent

I certify that I am physically and mentally able to participate in the Activities. I understand that InTouch Outreach (ITOR) does not provide medical insurance or coverage.

In the event of injury or emergency, I authorize InTouch Outreach (ITOR) to seek emergency medical treatment on my behalf if necessary. I agree to be fully responsible for any and all costs associated with such medical care.

Media Release and Consent

I grant InTouch Outreach (ITOR) an irrevocable, perpetual, worldwide, royalty-free license to photograph, record, and/or film me in connection with the Activities.

I authorize InTouch Outreach (ITOR) to use my name, likeness, image, voice, and/or statements in photographs, videos, and other media for promotional, educational, marketing, and informational purposes, including but not limited to websites, social media, print materials, and other communications, without compensation.

I understand and agree that:

• I will not receive payment or compensation for such use

• I waive any right to inspect or approve the finished materials

• These materials may be used indefinitely

• I release InTouch Outreach (ITOR) from any claims arising out of the use of such media

Binding Effect and Severability

This Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Indiana and shall be binding upon me and my heirs, assigns, personal representatives, and next of kin.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment of Understanding

By checking the box below and/or signing electronically, I acknowledge that:

• I have read and fully understand this Waiver and Release Agreement

• I understand that I am giving up certain legal rights, including the right to sue

• I agree to these terms voluntarily and without coercion
